Puppy Purchase Agreement and Contract

 Thank you for purchasing a puppy from Spartan! Our puppies are raised in our home and are important to us, as are you, their new owner. 

 Your purchase of a Spartan puppy comes with the following guarantees, terms and conditions.  Please read thoroughly prior to the purchase of your puppy.  Your clicking of the terms and conditions acceptance box is considered a legal acknowledgment that you have read, understood, and legally agreed to all guarantees, terms and conditions as set forth by Spartan Shepherds. 

 HEALTH GUARANTEE  

 Before going to their new homes, all of our puppies are given age appropriate de-wormer and vaccines. The puppy may be checked by your veterinarian within 48 hours after his arrival at your home. If the puppy does not pass the vet check (has a serious, life-threatening illness or problem), the purchase price of the puppy, less any shipping fees, will be refunded upon return of the puppy to Spartan and a letter from the veterinarian describing the problem encountered. Spartan is not responsible for any vet bills or return shipping. This guarantee is no longer in effect after the puppy has been in his/her new home more than 48 hours, as we have no control over his/her new environment.  If it is determined that the health of the puppy has been affected detrimentally by his/her new environment, this guarantee will be null and void. This guarantee does not cover the presence of parasites, viral or bacterial colds or infections such as Coccidia or Giardia, which are easily treated and are natural things that puppies can pick up. Puppies are naturally at risk for Coccidia, Giardia, worms, or other pathogens which is often brought on by the stress of a new home, new food, new people or just a change in environment.  

Serious genetic defects are covered by this guarantee for one year, including eyes and heart. Serious genetic defects are defined as a genetic mutation that greatly reduces the quality of life or greatly impacts normal, everyday life. A written examination from a veterinarian must state that a serious genetic defect exists and be accompanied by x-rays and other testing as appropriate. The breeder is not responsible for the vet bill, or the return shipping.  Issues that do not greatly affect the quality of life are not covered, such as, but not limited to, an undescended testicle, an ear that doesn't stand, heart murmurs, dental issues, issues resolved or treated with daily treatment, etc. Puppies that become sick or die due to an accident or buyer’s negligence (chewing electrical cords, hung by collar, exposing the puppy to strange dogs before fully vaccinated, etc.) will not be replaced. Spartan Shepherds reserves the right to have the pup examined by a different vet for a second opinion, if needed.  Under no circumstances will a refund be given. If a replacement puppy is provided, the original puppy must be spayed or neutered and kept as a companion.  Only one replacement puppy will be provided, and it will not be covered under the health guarantee. 

 HIP GUARANTEE  

 Spartan offers a 2 Year (26 month) Hip Guarantee against genetic, moderate or severe hip dysplasia.  Because up to 85% of all canine hip dysplasia is related to poor nutrition, excessive weight or environmental factors, we require that your precious puppy continue with the Life's Abundance Nutritional System for the first 26 months of his/her life in order to qualify for this 2 year health guarantee. Remember, an ounce of prevention is worth a pound of cure! If you continue with Life's Abundance Nutritional System for the first 26 months, this dog is guaranteed against genetic moderate or severe hip dysplasia until it is 26 months of age. The OFA is the sole and only judge in determining hip dysplasia.  If the puppy were to have moderate or severe hip dysplasia, the buyer is to spay or neuter (unless already done) the puppy and keep him/her as a companion.

The buyer(s) shall provide proper nutrition, vet care, shelter and exercise. The pup shall be socialized properly after all immunizations given, to include other people outside the family, other dogs, and strange places. Obedience classes are recommended before the pup is 1yr old. 

Your puppy is guaranteed to be free of hereditary hip dysplasia, providing the puppy has not been used for breeding (sired or whelped a litter), and that the defect is not caused by trauma, stress, neglect, abuse or any NON-inherited factor. If the hip dysplasia is determined by a veterinarian to be of NON-inherited origin, the guarantee is null and void, and will not be honored. We will replace the puppy with another puppy of equal value if the puppy is found to have severe hip dysplasia (moderate to extreme) in which the disease is crippling. The X-ray and a copy of the OFA letter of diagnosis must be given to the breeder. If the breeder so chooses, they have the right to have the X-ray’s re-done by their own veterinarian and submitted to OFA for a second opinion (many poor hip readings are inaccurate due to improper positioning by veterinarians and/or their staff).

 To be covered by this Hip/Health Guarantee, the same person who originally bought the puppy from Spartan must own the puppy. If the puppy is sold or given away to another person, the hip/healthguarantee will be null and void. Environment plays an important part in the development of healthy hips. If the puppy is allowed to become overweight or does not receive proper nutrition (Life's Abundance dog food), the hip guarantee will be null and void. If the puppy is over 26 months of age before being x-rayed and diagnosed, the hip guarantee will also be null and void. 

Early spaying/neutering has been proven to have detrimental effects to joint development and overall health. Spartan Shepherds requires pups to be at least 1 year old to be sterilized, in order to be covered by the Hip/Health guarantee. See the UC Davis study on our blog post. Under no circumstances will a refund be given. If a puppy is found to have a crippling genetic disease or crippling hip dysplasia, a replacement puppy will be provided. Only one replacement puppy will be provided, and the replacement puppy will not be covered under the hip and health guarantee. 

 REGISTERING YOUR PUP-

 Registering your puppy with AKC is optional. However, if you choose to register your puppy, you MUST register it in the name provided by Spartan. If you change the registered name of the puppy, the guarantee will no longer be in effect.

 LIFETIME REPLACEMENT PROGRAM

 Because we believe so strongly that nutrition plays a very big part in the health of an animal, we are offering a *Lifetime Free Replacement Puppy Guarantee.  Should you choose this, the lifetime guarantee stipulates that the puppy must be fed Life's Abundance Nutritional System & Agility Formula for their entire lifetime.  The Agility Formula must be given starting when the puppy is 6 months old.  The reason we have chosen to offer this distinctive guarantee, is because so many dogs are acquiring serious, life threatening health risks through poor diet and vitamin deficiency. We believe that these products provide the optimum nutritional benefits ensuring good health and longevity for the dog, which is why we are willing to stand behind this guarantee.  Average life expectancy of a German Shepherd is 10-13 years. If your German Shepherd does not reach it’s life expectancy of 10 years, you will be eligible to get a free replacement puppy of equal value.

Lifetime Free Replacement Puppy Information: - this guarantee does not include the vet check, CERF exam, shots, worming, transportation, carrier, or other fees. This Lifetime Free Replacement Puppy Health Guarantee is for the health of your German Shepherd, and does not cover accidental death, neglect, abuse, or injuries that your dog may sustain while being a part of your family. We believe that Life's Abundance Pet Food and Supplements are a great combination to provide your dog with optimal health, so that your GSD can live a long and happy life with your family!


BREEDER’S RIGHTS
 

Breeder has the right to, at any time; decide to stop breeding German Shepherd dogs. In this case, no replacement puppies shall be given and this contract is null and void.

Breeder makes no guarantees regarding the loss of the puppy due to accidental death, theft, sickness due to lack of vaccinations, etc., or any other loss beyond the Breeder's control except as stated above.

Breeder shall not be responsible for death or injury of said puppy/dog due to natural causes, negligence or carelessness of the Buyer, any airline, live animal carrier, it’s agents or employees.

 MUTUAL NON-DISPARAGEMENT

Client and Spartan Shepherds mutually agree to forbear from making, causing to be made, publishing, ratifying or endorsing any and all disparaging remarks, derogatory statements or comments made to any party with respect to either of them (any of its affiliates, or any of their respective officers, managers or directors) Further, the parties hereto agree to forbear from making any public or non-confidential statement with respect to the any claim or complaint against either party without the mutual consent of each of them, to be given in advance of any such statement. Legal action can be pursued if either party breaks this agreement.

WHAT FOOD SHOULD BE FED TO MY NEW PUPPY?

 We feed Life's Abundance dog food, you can read all about it on our "Nutrition" tab. You may feed an alternative product, but guarantees made by Spartan are nullified.  Buyer has a 7 day grace period from the date of purchase of the puppy to order their new puppy food. Should you choose an alternative formula, seek advice from your veterinarian in how best to transition to a new feeding schedule. 

HOW DOES SHIPPING WORK? 

Ground shipping is available once or twice a month, and you must be flexible on the delivery time as routes change. Ground shipping is typically between $800-1200, door to door delivery. We have shipped many puppies and have years of experience. We have shipped to multiple countries around the world, and to every state in the US, except Hawaii (they have very stringent and lengthy quarantine requirements). We have never had a puppy harmed by either method of shipping and all have arrived safe and sound. Spartan Shepherds, or its members, are not responsible for accidental injury, infection, or death during transport of an animal.
